practitioner in the enterprise expects answers to the following
questions: Who is, as manufacturer and user (also operator), through
the implementation of the EC law in the respective enterprise
organisation competent and bears the legal responsibility?
In
particular:
• Who falls under the terms “manufacturer”
and “user” (operator) and other terms used by
lawmakers and regulation makers for the intended addressee of
norms?
• How are, in the enterprise hierarchy, the legally required
obligations distributed to executive staff and other
“responsible persons”?
• What are the legal risks for this group of persons both in
the home country and abroad?
This
compilation does not deal in detail with the formal transfer of
entrepreneurial obligations and the legal consequences in case of
non-compliance.
